Street Trading Consents
Only persons licensed by Dover District Council's Licensing
Section may trade from the street.
Street trading means the selling, exposing for sale, or offering
for sale of any article (including a living thing) in a
street. Certain types of selling are exemptions from being
street trading.
The local authority has powers to designate all or some of the
streets in a district as consent streets, licence streets or
prohibited streets. An authority from the local council is
required to trade on any consent street, or a licence street and it
is an offence to trade in those streets without such a consent or
licence or to trade at any time on a prohibited street.
Dover District Council has designated a number
of streets as "Consent
Streets". It has not designated any streets as "licensed
streets” or “prohibited streets”.
A street trading consent may last for any period up to 12 months
in duration but may be revoked at any time.
The local authority must not grant consent
to:
- A person under the age of 17
years
- For any trading in a highway to which a
control order under Section 7, Local Government (Miscellaneous
Provisions) Act 1976 is in force (other than trading not covered by
that section)
Applications must be
made on the prescribed form and be accompanied by the requisite fee.
Local residents or business operators may make representations
in support of, or against, any application for a street trading
consent. Should this occur the application will be brought
before a committee to determine the matter.
The local authority, including the committee at any
hearing, may attach such conditions as they think reasonable
to any consent and in particular may include conditions to
prevent:
- Obstruction to the street or danger to persons using it,
- Nuisance or annoyance whether to persons using the street or
otherwise
If the local authority allows trading from a vehicle,
barrow or portable stall they may condition the location and
periods of time when that vehicle, barrow or stall may be used
