Scrap Metal Dealers
Scrap Metal Dealers Act 1964
Any person who wishes to trade as a scrap metal dealer must be
registered with the local authority. Registration lasts for 3
years
Vehicles salvage operators are required to be registered with
the Kent County Council under
the Vehicles (Crimes) Act 2001.
A person will be treated as carry out the business of a scrap
metal dealer if:
- a place within that area is occupied by him as a scrap metal
store
- no place is occupied by him as a scrap metal store, whether in
that area or elsewhere, but he has his usual place of residence in
that area, or
- no place is occupied by him as a scrap metal store, whether in
that area or elsewhere, but a place is occupied by him wholly or
partly for the purpose of that business.
Application for registration must be made on the appropriate form and accompanied by the
requisite fee before registration will
take place.
Carrying on the business of a scrap metal dealer without
being registered is an offence
Scrap metal dealers are required to keep a register of all scrap
metal received and all scrap metal processed or disposed of by them
during the course of their business. Seperate books may
be used for each requiement. The register for receipt of
scrap metal must contain:
- description and weight of the scrap metal,
- date and time of receipt,
- the full name and address of the person depositing the scrap
metal if not the dealer,
- the price payable in respect of the metal if fixed prior to the
entry as estimated by the dealer at the time of receipt
- the registration number of any vehicle used to deliver the
scrap metal whether belonging to the dealer or not.
The register relating to the processing or disposal of scrap
metal must contain:
- description and weight of the scrap metal,
- the date of process or disposal and method used if
processed
- in the case of scrap metal sold or exchanged, the full name and
address of the person to whom disposed and the consideration
received
- if disposed other than by sale or exchange, the value of the
scrap immediately before processing or despatched as estimated by
the dealer.
Processing includes the melting down of scrap metal, or any
other process, whereby the metal ceases to be scrap
Power of Entry
A police officer may, at all reasonable times, enter any
place registered as a scrap metal store or occuppied wholly or
partly by a scrap metal dealer for the purposes of his business
and
- inspect those premises
- require the production of and inspect any scrap
metal kept at the place
- require the production of and inspect any book kept at the
premises
- take copies of any book record or receipt.
